TEMPO.CO, Jakarta - The Minister of Primary and Secondary Education, Abdul Mu'ti, said President Prabowo Subianto has yet to give any instructions on the top court's ruling regarding free private schools. The minister said all discussions on the matter remain limited within the ministries thus far.
"But we are awaiting the president's directives to take the next steps," Mu'ti said when met at the ministry's office in Jakarta on Tuesday, June 3, 2025, while affirming that the government will implement the Constitutional Court's decision.
Mu'ti also said his ministry has held talks with the Ministry of Finance and other relevant ministries to prepare for the implementation, with another meeting slated for June 12.
"Because legally, the Constitutional Court's decision is final and binding. So, there is no reason for us not to follow that decision," Mu'ti said.
On a different occasion, the Secretary General of Muhammadiyah, one of Indonesia's largest Muslim organizations, said that the government must revamp its mid-year budget to implement the court's decision. Thus, he said, the government must consider its budget before imposing a policy.
Previously, the Constitutional Court granted the lawsuit of the Indonesian Education Monitoring Network (JPPI) demanding free education for both public and private schools. The Court obliged the government to provide nine years of basic education for free in public and private schools.
JPPI and three applicants on behalf of Fathiyah, Novianisa Rizkika, and Riris Risma Anjiningrum challenger Article 34 paragraph (2) of Law Number 20 of 2003 concerning the National Education System. This case was registered with Case Number 3/PUU-XXII/2024.
