Prabowo Ratifies New Criminal Procedure Code into Law

TEMPO.CO, Jakarta - Indonesian President Prabowo Subianto has authorized the revision of the Criminal Procedure Code (KUHAP) to become Law No. 20 of 2025. The inauguration took place on December 17, 2025.

"KUHAP has been authorized by the president on December 17, 2025, with number 20 of 2025," said the Director General of Legislation at the Ministry of Law when contacted by Tempo on Thursday, December 18, 2025.

Dhahana stated that his ministry is currently drafting the regulations to implement the KUHAP revision. The codified law will have three derivative regulations, namely the Draft Presidential Regulation on the Integrated Criminal Justice System Based on Information Technology, the Draft Government Regulation on Restorative Justice, and the Draft Government Regulation on the Implementation of KUHAP.

According to Dhahana, two of these regulations have been successfully harmonized, namely the Draft Presidential Regulation on the Integrated Criminal Justice System Based on Information Technology and the Draft Government Regulation on Restorative Justice. "The Draft Government Regulation on the Implementation of KUHAP is still in process," he said.

In a separate meeting, Deputy Minister of Law Edward Omar Sharif Hiariej targeted the completion of the new KUHAP implementing regulations by December 31, 2025. This target is set to meet the enforcement of the new KUHAP and Criminal Code on January 2, 2026.

Eddy expressed optimism that all law enforcement officials are ready to implement the two new laws in 2026. Moreover, the National Police and the Attorney General had previously signed a memorandum of understanding regarding the implementation of the new Criminal Code and KUHAP on December 16, 2025.

"But once again, I emphasize that our law enforcement officials are ready to welcome the new Criminal Code and KUHAP," he said on Tuesday, December 16, 2025, at the National Police Criminal Investigation Department.

The new KUHAP was authorized on November 18 and will come into effect simultaneously with the Criminal Code at the beginning of next year. The socialization period for the new KUHAP is less than two months, shortened by the Christmas and New Year holidays.

The Civil Society Coalition for the Revision of the KUHAP, consisting of 34 organizations, urged President Prabowo Subianto to issue a Government Regulation in Lieu of Law (Perppu) to postpone the enforcement of the new KUHAP. They considered the socialization period to be too short and were concerned that the government may not complete all implementing regulations on time.

According to the coalition, the new KUHAP requires the issuance of at least 25 government regulations, one presidential regulation, one Supreme Court regulation, and one law. These implementing regulations provide more detail on the general provisions of the KUHAP to ensure they can be applied technically and operationally.

The coalition believed that without these regulations, law enforcement officials are at risk of deviating from the KUHAP norms. The government must socialize the new KUHAP and dozens of implementing regulations within a matter of weeks. "With such a short time, is it possible for law enforcement officials across Indonesia to be socialized?" said the Coalition.

For comparison, the new Criminal Code has a full three-year socialization period after it was enacted in 2023. However, nearly three years later, the government has not yet succeeded in enacting the implementing regulations for the Criminal Code.
