TII: 31 Indonesian Deputy Ministers Still on SOE Boards Despite Court Ban

TEMPO.CO, Jakarta – At least 31 Indonesian deputy ministers continue to serve as commissioners at state-owned enterprises (SOEs) despite a Constitutional Court ruling barring them from holding dual positions, according to Transparency International Indonesia.

The court ruled in Decision No. 128/PUU-XXIII/2025 that deputy ministers should no longer simultaneously serve on SOE boards due to the potential for conflicts of interest.

The ruling, issued in August 2025, gave the government a two-year transition period to remove deputy ministers from SOE board positions. The same provision was later incorporated into Indonesia's 2025 SOE Law.

TII researcher Ferdian Yazid said little progress has been made.

"SOEs are still maintaining boards that include deputy ministers," Ferdian told Tempo on Tuesday, June 30.

Before the ruling, 34 deputy ministers held commissioner positions at state-owned companies. Nearly a year later, TII found that only three have left those posts, with some departures linked to corruption cases.

Deputy Ministers Still Serving on SOE Boards

According to TII data, the 31 deputy ministers are:

  • Suahasil Nazara — Deputy President Commissioner/Commissioner, PLN

  • Helvi Yuni Moraza — Commissioner, Bank Rakyat Indonesia

  • Diana Kusumastuti — President Commissioner, Brantas Abipraya

  • Yuliot Tanjung — Commissioner, Bank Mandiri

  • Didit Herdiawan Ashaf — President Commissioner, Perikanan Indonesia

  • Suntana — Deputy President Commissioner, Pelindo

  • Dante Saksono Harbuwono — Commissioner, Pertamina Bina Medika

According to TII, several SOEs had opportunities to comply with the court ruling during recent annual general meetings of shareholders but chose to retain deputy ministers on their boards.

At PLN, for example, shareholders retained Bambang Eko Suhariyanto and Suahasil Nazara as commissioners during the company's annual meeting on June 28. Likewise, Telkom Indonesia kept Angga Raka Prabowo as president commissioner during its annual shareholders' meeting on June 8.

Ferdian said the decisions suggest the government has yet to act on the Constitutional Court's ruling.

"This sets a bad precedent and ignores the spirit of the Constitutional Court's decision to reduce the risk of conflicts of interest as soon as possible," he said.

Tempo has sought comment from the Presidential Palace regarding deputy ministers who continue to serve as commissioners at state-owned enterprises.
